Divorce
Divorce marks the legal finish of a marriage. The Court is not concerned about the cause of the marriage breakdown but must be satisfied that there is an "irretrievable breakdown" of the marriage. This is established by proof that the parties have lived separate lives for a period of one year. Property Settlement Both parties to a marriage or defacto relationship have rights in respect of matrimonial property, whether or not both parties have financially contributed to the marriage or contributed in some other non-financial way. (e.g. care for children/home duties) You should be aware of your rights before discussing property settlement with your spouse.
