  Children
  • Where should they reside?
  • If they reside with the other parent, am I entitled to have contact with my child?
  • Am I entitled to maintenance?

The Family Court has always put the welfare of the children as paramount before any other considerations. The Court expects separated parents to take the same approach with their children and discuss with a Counsellor, if necessary, what is appropriate and in the best interests of their children.

A parent who has the children of the relationship in their care is entitled to be paid maintenance by the other parent. The amount of maintenance varies and is based upon the amount of income received, and the needs of the children.

DO YOU NEED ANSWERS TO THESE QUESTIONS?

  • Who will have daily care and control of the children?
  • Who is to make major decisions about the children in the future?
  • How often should the children see the parent they do not live with?
  • How much is to be paid towards supporting the children?
  • How will the property (home, furniture, car, etc) be divided up?
